FixControl Terms of Service

§ 1. General Provisions

  1. These Terms of Service govern the provision of electronic services through the FixControl service (hereinafter: "Service"), available at https://fixcontrol.pl, operated in accordance with Polish law on the provision of electronic services.
  2. The owner and administrator of the Service is Nadzory Budowlane Grzegorz Turowski, address: Czerska 33/16, 80-180 Gdańsk, Poland, VAT ID: 8461594579, e-mail: [email protected] (hereinafter: "Service Provider").
  3. The FixControl Service allows Users to manage construction defects, document building deficiencies and issues, generate PDF and Excel reports, and use the mobile application and web panel (hereinafter: "Services").
  4. Using the Service constitutes acceptance of these Terms. Users are required to read the Terms before using the Service.
  5. The Terms are made available free of charge on the Service website in a form that allows them to be downloaded, saved and printed.

§ 2. Definitions

  • "User" — a natural or legal person representing a Company, using the Service after Registration.
  • "Company" — an entity (business or individual operating commercially) registered in FixControl, for which a separate account and data are maintained.
  • "Registration" — a one-time action of creating a Company Account by providing company name, email address, and setting an administrator login and password.
  • "Account" — the Company's individual panel in FixControl, accessible after login, enabling management of defects, locations, floor plans and sub-accounts.
  • "Services" — electronic services provided by the Service Provider to the User, including in particular: registration and management of construction defects, photographic documentation, report generation, and floor plan management.
  • "Terms" — this document.

§ 3. Technical Requirements

  1. Use of the Service requires: (a) a device with Internet access, (b) an up-to-date web browser with JavaScript and cookies enabled (for the web panel), (c) Windows 10 or newer, or Android 6.0 or newer (for the mobile application), (d) an active email account.
  2. The Service Provider is not responsible for technical problems or limitations on the User's side that prevent or impede the use of the Service.

§ 4. Registration and Account

  1. Registration is voluntary and free of charge.
  2. To register, the User provides: company name, company email address, and administrator login credentials (username and password).
  3. The User undertakes to provide accurate information and not to share login credentials with third parties.
  4. The User bears full responsibility for all actions taken through their Account.
  5. The Service Provider may refuse registration or delete an Account in case of violation of these Terms.
  6. The User may at any time request Account deletion by sending a request to the Service Provider's email. The Account will be deleted within 14 days of receiving the request.

§ 4a. Trial Bonus for New Accounts

  1. Every newly registered company account automatically receives a Trial Bonus in the amount (number of packages) and for the duration specified in the current information displayed on the Service's home page on the date of registration (hereinafter: "Trial Bonus").
  2. The Trial Bonus is granted free of charge and does not require providing payment card details or making any payment.
  3. The Trial Bonus is granted once only — exclusively upon the first registration of a company account. It is not available again if the same User creates another account.
  4. After the trial period ends, the Trial Bonus expires automatically. The account reverts to the Free plan unless the User purchased a subscription before or during the trial period.
  5. Data entered by the User during the trial period is retained after its expiry — it is not deleted automatically.
  6. The Service Provider reserves the right to change the Trial Bonus conditions (including its size and duration) for future registrations, while honouring already granted Trial Bonuses.

§ 5. Rules of Use

  1. The User undertakes to use the Service in accordance with applicable law, these Terms and good practices.
  2. In particular it is prohibited to: (a) provide unlawful content, (b) take actions that may disrupt the proper functioning of the Service, (c) use the Service in a manner contrary to its purpose, (d) copy, distribute or share Service content with third parties without the Service Provider's consent.
  3. The Service Provider reserves the right to temporarily suspend access to the Service for maintenance, updates or in cases of force majeure.

§ 6. Fees and Payments

  1. Use of certain Service features may require a paid subscription plan. Details, prices and scope of each plan are available in the "Pricing" section.
  2. Subscription payments are processed by two payment operators depending on the selected currency:
    • Przelewy24 (PayPro SA, ul. Kanclerska 15, 60-327 Poznań, Poland) — PLN payments; supports bank transfers, BLIK, card payments and other methods.
    • Stripe (Stripe, Inc., 510 Townsend Street, San Francisco, CA 94103, USA) — EUR and USD payments; monthly recurring subscription, cancellable at any time.
  3. Data required for payment processing (email, amount, order description) are passed to the selected operator. The Service Provider does not process payment card data directly. Privacy policies: Przelewy24 — https://www.przelewy24.pl/regulamin; Stripe — https://stripe.com/privacy.
  4. After payment, the Service Provider receives a status notification (webhook) from the operator, on the basis of which the selected subscription plan is activated.
  5. Stripe payments (EUR/USD) are recurring monthly subscriptions. Users may cancel at any time via the Stripe customer portal available in the Service admin panel.
  6. The Service Provider is not responsible for payment operator outages or delays. Payment complaints may be sent to the Service Provider's email ([email protected]) or directly to the relevant operator.

§ 7. Intellectual Property

  1. All content in the Service, including software, graphics, logos, texts and source code, is the property of the Service Provider or its licensors and is protected by copyright law.
  2. Use of Service content is permitted only for the User's personal use. Any copying, distribution or commercial use without the Service Provider's written consent is prohibited.

§ 8. Personal Data (GDPR)

  1. The Service Provider is the controller of Users' personal data.
  2. Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR) and applicable Polish data protection law.
  3. Data is processed for: (a) providing Services — Art. 6(1)(b) GDPR, (b) compliance with legal obligations — Art. 6(1)(c) GDPR, (c) legitimate interests of the Service Provider — Art. 6(1)(f) GDPR.
  4. Data collected includes: company name, company email address and account administrator login.
  5. Users have the right to: access, rectification, erasure ("right to be forgotten"), restriction of processing, data portability, objection, and the right to lodge a complaint with the supervisory authority.
  6. Providing personal data is voluntary but necessary to use the Service.
  7. Detailed data processing rules are set out in the Privacy Policy.

§ 9. Cookies and Analytics

  1. The Service uses cookies to ensure proper functioning and to maintain logged-in User sessions.
  2. The Service uses Google Analytics 4 (GA4) to collect anonymous traffic statistics. Analytics cookies are loaded only after the User's consent via the cookie banner at first visit.
  3. Users may change cookie settings in their browser at any time. Details are in the Privacy Policy.

§ 10. Liability

  1. The Service Provider makes every effort to ensure the Service runs continuously and correctly, but does not guarantee uninterrupted or error-free availability.
  2. The Service Provider is not liable for: (a) Service interruptions due to causes beyond its control, (b) consequences of improper use by the User, (c) content and data entered by Users into the system.

§ 11. Complaints

  1. Users have the right to submit complaints about the functioning of the Service.
  2. Complaints should be sent to: [email protected].
  3. A complaint should include: (a) the User's email address, (b) a description of the problem, (c) the User's expectations regarding resolution.
  4. The Service Provider will respond within 14 days of receiving the complaint.

§ 12. Dispute Resolution

  1. Disputes between the Service Provider and a consumer User may be resolved amicably via the EU Online Dispute Resolution (ODR) platform at: https://ec.europa.eu/consumers/odr/.
  2. If no amicable resolution is reached, disputes shall be resolved by the competent common court under Polish procedural law.

§ 13. Changes to Terms

  1. The Service Provider reserves the right to amend these Terms for important reasons.
  2. Users will be notified of any changes by email at least 14 days before they take effect.
  3. Users who do not accept the changes may delete their Account before the effective date.

§ 14. Final Provisions

  1. Matters not regulated by these Terms are governed by Polish law.
  2. If any provision of these Terms is found to be invalid, this shall not affect the validity of the remaining provisions.
  3. These Terms are effective from 24 March 2026. Last updated: 13 May 2026.
